EXCHANGE, CANCELLATION & LIMITED LIABILITY POLICY

BERGARIA LUXURY

This Exchange, Cancellation & Limited Liability Policy (“Policy”) governs all purchases made through www.bergarialuxury.com (“Website”). By placing an order, you (“Customer”, “you”, or “your”) expressly agree to be bound by the terms set forth below.

BERGARIA LUXURY (“BERGARIA”, “we”, “our”, or “us”) reserves the right to interpret, modify, or enforce this Policy at its sole discretion, in compliance with applicable laws of India.

1. PRODUCT NATURE & NO RETURN POLICY

Perfume and fragrance products are personal use items and are subject to strict hygiene, safety, and quality control standards.

Accordingly:

  • All sales are final. We do not accept returns once a product has been delivered.
  • Returned goods cannot be restocked or resold due to contamination risks.
  • By placing an order, you acknowledge and accept that returns are not permitted under any circumstances, except where mandated under applicable consumer protection laws.

Customers are solely responsible for reviewing product descriptions, notes, and specifications prior to purchase.

2. MANDATORY EVIDENCE REQUIREMENT (UNBOXING VIDEO)

To ensure transparency and prevent fraudulent or unverifiable claims, Bergaira requires strict proof of delivery condition.

A clear, continuous, and unedited unboxing video is a mandatory prerequisite for any claim relating to:

  • Damaged or leaking products
  • Incorrect product(s) delivered
  • Missing items

Video Compliance Requirements:

The video must:

  • Begin prior to opening the outer courier package
  • Clearly display: Shipping label and outer packaging Inner packaging condition Product bottle, seal, and cap
  • Be recorded in one uninterrupted take, without edits, cuts, or filters

Non-Compliance Clause:

Failure to provide valid video evidence in accordance with the above requirements shall result in automatic rejection of the claim, without exception.

We shall not be liable for claims that are unverifiable due to insufficient or non-compliant evidence.

3. LIMITED EXCHANGE POLICY

Exchanges are permitted only under the following strictly defined conditions:

  • Product received is physically damaged or leaking at the time of delivery
  • Incorrect product or variant has been delivered
  • Product remains unused, unopened, and in original saleable condition with all seals, caps, and packaging intact

Explicit Exclusions:

Exchanges shall not be provided for:

  • Subjective dissatisfaction with fragrance (e.g., dislike of scent)
  • Minor packaging imperfections not affecting product performance
  • Claims raised without valid proof (as per Section 2)

4. EXCHANGE CLAIM PROCEDURE

To initiate an exchange request:

Step 1: Notification Timeline

  • Customer must notify Bergaria within 48 hours of delivery
  • Requests beyond this period shall be automatically rejected

Step 2: Submission of Proof

Send the following to care@bergarialuxury.com or WhatsApp +91 8743845939:

  • Order Number
  • Description of issue
  • Mandatory unboxing video

Step 3: Review & Approval

  • Claims will be reviewed within 1–2 business days
  • Bergaria reserves the sole right to approve or reject any request

Step 4: Return & Inspection

  • Approved cases must return the product as instructed
  • Products failing quality inspection will be rejected and returned to the customer at their expense

Step 5: Replacement

  • Approved exchanges will be processed within 3–5 business days, subject to stock availability

We reserve the right to provide store credit in lieu of replacement, where necessary.

5. ORDER CANCELLATION POLICY

Cancellation Window:

Orders may only be cancelled if:

  • Cancellation is requested within 24 hours of order placement, AND
  • The order has not been processed, packed, or shipped

Once an order enters fulfillment or is dispatched, cancellation is strictly prohibited.

Refund Processing:

  • Approved cancellations will be refunded to the original payment method
  • Processing timeline: 5–7 business days, subject to banking/payment gateway timelines
  • Bergaria shall not be liable for delays caused by third-party financial institutions

6. DAMAGED, INCORRECT, OR MISSING ITEMS

Upon receipt of valid and compliant proof (as per Section 2), Bergaria shall, at its sole discretion:

  • Provide a replacement product, OR
  • Issue store credit equivalent to the product value

No monetary refunds shall be issued for such claims unless required under applicable law.

7. LIMITATION OF LIABILITY

To the fullest extent permitted under applicable law:

  • Bergaria Luxury shall not be liable for any indirect, incidental, special, or consequential damages arising from product use
  • Liability, if any, shall be strictly limited to the purchase value of the product
  • Bergaria Luxury makes no guarantees regarding individual scent perception, longevity, or performance, as these are subjective and may vary

8. FORCE MAJEURE

Bergaria Luxury shall not be held liable for failure or delay in performance due to events beyond its reasonable control, including but not limited to:

  • Natural disasters
  • Logistics disruptions
  • Government actions
  • Pandemics or unforeseen circumstances

9. GOVERNING LAW & JURISDICTION

This Policy shall be governed by and construed in accordance with the laws of India.

All disputes shall be subject to the exclusive jurisdiction of courts located in New Delhi, India.

11. POLICY UPDATES

Bergaria Luxury reserves the right to modify or update this Policy at any time without prior notice. Updates shall become effective immediately upon publication on the Website.

Continued use of the Website constitutes acceptance of the revised Policy.

  • You accept the No Return condition
  • You agree to provide mandatory evidence for claims
